FOOBEE, LLC, PRIVACY POLICY

  The privacy of our users is incredibly important to us! This privacy policy explains how we collect, store, protect, and share your information, and with whom we share it. We suggest you read this in conjunction with our Terms of Use and Dating Safety Policy.

  Foobee, LLC (“Foobee,” “we,” or “us”) respects the privacy of our users (“user” or “you”) and has developed this Privacy Policy to demonstrate our commitment to protecting your privacy. This Privacy Policy describes the information we collect, how that information may be used, with whom it may be shared, and your choices about such uses and disclosures. We encourage you to read this Privacy Policy carefully when using our app or services or transacting business with us. By using our website(s), App(s), or any other online service(s) (our “Service”), you are accepting the practices described in this Privacy Policy. You agree that we can collect, transfer, store, disclose and use your information as described in this Policy. Foobee is a global App, and your information will be sent over the cloud and such information used in the United States regardless of the country you reside in, and by downloading our App you consent to such transfer.

  If you have any questions about our privacy practices, please refer to the end of this Privacy Policy for information on how to contact us.

SECTION 1: INFORMATION WE COLLECT ABOUT YOU.

  We may collect Personal Information, including Sensitive Data, and other information. “Personal Information” means individually identifiable information that would allow us to determine the actual identity of, and contact, a specific living person. Sensitive Data may include information, comments or content including your:

  • Name.
  • Username
  • Email address;
  • Gender identity.
  • Date of birth.
  • Mobile number.
  • Sexual preference.
  • Location.
  • Login information for social media accounts that you connect to your Foobee Account (this could include, but not limited to, your Facebook, Twitter, Snapchat, or Instagram accounts ("Social Media Accounts").

  “Sensitive Data” also includes other items such as photographs, videos, blogs, comments, profile, lifestyle, social media posts, etc., that you optionally provide that may reveal your ethnic origin, nationality, religion and/or sexual orientation. By providing Sensitive Data to us, you consent to the collection, use and disclosure of Sensitive Data as permitted by applicable privacy laws. We specifically also collect your geolocation information with your consent. We may collect this information through a website, mobile application, or other online services. By using the Service, you are authorizing us to gather, parse and retain data related to the provision of the Service. When you provide personal information through our Service, the information may be sent to servers located in the United States and countries around the world.

  You control your user profile and are able to correct or update your information at any time by logging in to Foobee. The information we collect helps to enhance the App and verify our Users. Registration Information such as your name and username may be visible to the public on your profile page.

Additional Information

  We may ask you to provide your full name, address and email address. You agree that such details may be shared with third parties for purposes relating to, for example, any of our loyalty programs, sending gifts or delivery of merchandise.

  If you contact our Customer Support team, we will receive your email address, and may track your IP address as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive from you about other users (and from other users about you).

  We recommend and encourage you to carefully consider the information you choose to disclose about yourself. Please be careful about posting sensitive details about yourself on your profile such as your religious denomination or health details. While you may voluntarily provide this information when you create your profile, including your sexual preferences, there is no requirement to do so. Please remember that photographs or videos that you post on Foobee may reveal information about yourself as well. Where you do upload and choose to tell us sensitive information about yourself, you are explicitly consenting to our processing of your information and making this public to other users.

  When you post information about yourself or use the messaging function, the amount of personal information you share is at your own risk. If you post anything that is inconsistent with our Terms of Use, we reserve the right to terminate your Account.

  For safety and security and to ensure you have the best possible user experience, we may require users to verify their accounts and ask for your phone number in order to prevent “fake” accounts, adherence to our Terms of Use, and to provide optimum user services. We may use a third party provider for account verification who may keep your phone number for up to 90 days for fraud identification purposes across a range of online platforms and services like Foobee. We may collect and use your phone number on the basis of our legitimate interests identified above and for the prevention of fraud or other malicious purposes.

  If you decide to purchase any additional or premium services we may offer, we will process your payment information and retain this securely for the prevention of fraud and for audit/tax purposes. Under data protection law, it is necessary for us to collect and process this payment data to enable us to perform our contract with you and our ongoing retention of this data is justified by our legitimate interests set out above.

  You also consent to us using your email address and phone number to send you information on updates, promotions, marketing, or other offers we have available. Of course, you can withdraw this consent at any time.

Data Storage

  By using the App, you agree and acknowledge that Foobee is a global app operating over the cloud and through servers located in a number of countries around the world, including the United States. If you live in a country with data protection laws, the storage of your personal data may not provide you with the same protections as you enjoy in your country of residence. By submitting your personal information, or by choosing to upgrade the services you use, or by making use of the applications available on Foobee, you agree to the transfer of your personal information to, and storage and processing of your personal information in, any such countries and destinations, and over the cloud.

Geolocation Information

  If you turn these features on, when you use your mobile, we will collect information about WiFi access points as well as other location information about your longitude and latitude and may save your device's coordinates to offer certain features and advertisements to you. This information helps us identify your physical location and we may use it to personalize the App and make it easier for you to interact with other Users, by enabling the information to be displayed and shared with other members choosing to view “nearby” posts.

  If you have enabled location services, but wish to turn it off, you can do so by the following methods:

  • iPhone - Settings, Privacy, Location Services, Foobee.
  • Android - Profile, Privacy, Off.

Log and Usage Data

  Our servers automatically record information ("Log and Usage Data") created by your use of the Service, which again helps us to improve our service. Log and Usage Data may include information such as your IP address, browser type, the referring domain, pages visited, access times, your mobile carrier, and search terms. Other actions, such as interactions with Foobee and advertisements, may also be included in Log and Usage Data.

  Where you request that your profile be deleted via the app, it is immediately made unavailable and fully deleted within 30 days. Correspondence with our Customer Support team will be retained for longer to allow us to deal with any subsequent queries you may have but will usually be deleted within 6 years if there are no queries.

  Information such as payment information, IP addresses, mobile numbers and email addresses are retained for anti-fraud and anti-spam purposes for as long as they are relevant. This is usually determined by the expiry of the payment method.

Device Information

  We may collect information about your device when you use the App including the unique device identifier, device model, operating system, and MAC address. In addition, if you permit us to do so, the App may access your device's address book solely in order to add someone to your contacts.

Links

  We may keep track of how you interact with links available on Foobee including third party services and clients by redirecting clicks or through other means. We may share aggregate click statistics such as how many times a particular link was clicked on.

Information you provide and what others may see about you.

  When using Foobee, you should assume that anything you post or submit on the App may be publicly-viewable and accessible, both by users of the App and non-users of the App. We want our users to be careful about posting information that may eventually be made public.

Information from other sources.

  Foobee may be now or in the future become part of a family of businesses. We may obtain or share both personal and non-personal information about you from other such family businesses, business partners and other third parties.

Use of technologies to collect information.

  We use various technologies to collect information from your device and about your activities on our Service.

Information collected automatically.

  We automatically collect information from your browser or mobile device when you visit our Service. This information could include your IP address, device ID and type, your browser type and language, the operating system used by your device, access times, your mobile device’s geographic location while our application is actively running, and the referring website address.

Cookies and use of cookie and similar data.

  When you visit our Service, we may assign your device one or more cookies or other technologies that facilitate personalization to facilitate access to our Service and to personalize your experience. Through the use of a cookie, we also may automatically collect information about your activity on our Service, such as the pages you visit, the time and date of your visits and the links you click. If we advertise, we (or third parties) may use certain data collected on our Service to show you Foobee advertisements on other sites or applications.

  If for any reason you decide that you do not want all of your Foobee activities to be stored you may set your browser and mobile settings to block cookies and local storage devices, however, if you do so, you may not be able to access all of the features Foobee offers now or in the future.

Pixel tags.

  We embed pixel tags (also called web beacons or clear GIFs) on web pages, ads, and emails. These tiny, invisible graphics are used to access cookies and track user activities (such as how many times a page is viewed). We use pixel tags to measure the popularity of our features and services. Ad companies also use pixel tags to measure the number of ads displayed and their performance (such as how many people clicked on an ad).

Mobile device IDs.

  If you are using our app, we use mobile device IDs (the unique identifier assigned to a device by the manufacturer), or Advertising IDs (for iOS 6 and later), instead of cookies, to recognize you. We do this to store your preferences and track your use of our app. Unlike cookies, device IDs cannot be deleted, but Advertising IDs can be reset in “Settings” on your iPhone. Ad companies also use device IDs or Advertising IDs to track your use of the app, track the number of ads displayed, measure ad performance and display ads that are more relevant to you. Analytics companies use device IDs to track information about app usage.

Information collected by third-parties for advertising purposes.

  We allow service providers, merchants, businesses, individuals, advertising companies and ad networks, and other third parties to display advertisements on our Service and elsewhere. These companies may use tracking technologies, such as cookies or web beacons, to collect information Meet The Teamers who view or interact with their advertisements. We do not provide any non-masked or non-obscured personal information to third parties. Some of these third-party advertising companies may be advertising networks that are members of the Network Advertising Initiative, which offers a single location to opt out of ad targeting from member companies (www.networkadvertising.org). SECTION 2: HOW WE USE THE INFORMATION WE COLLECT.

In general

  We may use information that we collect about you to:

  • Deliver and improve our products and services, and manage our business.
  • Manage your account and provide you with customer support.
  • Perform research and analysis about your use of, or interest in, our or others’ products, services, or content.
  • Communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us or other third parties.
  • Develop, display, and track content and advertising tailored to your interests on our Service and other sites, including providing our advertisements to you when you visit other sites
  • Website or mobile application analytics.
  • Verify your eligibility and deliver prizes in connection with contests and sweepstakes.
  • Enforce or exercise any rights in our Terms of Use.
  • Prevent “fake” accounts.
  • Perform functions or services as otherwise described to you at the time of collection.

SECTION 3: DISCLOSURE OF INFORMATION

  When you register as a user of Foobee, your Foobee profile will be viewable by other users of the Service. Other users (and in the case of any sharing features available on Foobee, the individuals or apps with whom a Foobee user may choose to share you with) will be able to view information you have provided to us directly or through Facebook, such as your Facebook photos, any additional photos you upload, your first name, your age, approximate number of miles away, your personal description, and information you have in common with the person viewing your profile, such as common Facebook friends and likes. If you swipe right or use voting buttons to say “yes” to a person, you will be able to chat with that person if they swipe right or use voting buttons to say “yes” to you, e.g., when you have a “match.” If you chat with your match, of course your match will see the content of your chat.

Personal information.

  We do not share your personal information with others except as indicated in this Privacy Policy or when we inform you and give you an opportunity to opt out of having your personal information shared.

Service providers.

  We may share information, including personal and financial information, with third parties that perform certain services on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, ad tracking and analytics, member screenings, supporting our Service functionality, and supporting contests, sweepstakes, surveys and other features offered through our Service. These service providers may have access to personal information needed to perform their functions but are not permitted to share or use such information for any other purposes.

Other Foobee Group Businesses.

  Foobee’s businesses include FoobeeApp online and/or mobile dating websites and apps, Foobee Entertainment, and may include other businesses in the future. We may share information we collect, including your profile and personal information such as your name and contact information, photos, interests, activities and transactions on our Service with other Group Businesses, subject to your consent where required under applicable law.

Other Situations.

  We may disclose your information, including personal information:

  In response to a subpoena or similar investigative demand, a court order, or a request for cooperation from a law enforcement or other government agency; to establish or exercise our legal rights; to defend against legal claims; or as otherwise required by law. In such cases, we may raise or waive any legal objection or right available to us.

  When we believe disclosure is appropriate in connection with efforts to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing; to protect and defend the rights, property or safety of our company, our users, our employees, or others; to comply with applicable law or cooperate with law enforcement; or to enforce our Terms of Use or other agreements or policies.

  In connection with a substantial corporate transaction, such as the sale of our business, a divestiture, merger, consolidation, or asset sale, or in the unlikely event of bankruptcy.

Aggregated and/or non-personal information.

  We may use and share non-personal information we collect under any of the above circumstances. We may also share it with other Foobee companies and third parties to develop and deliver targeted advertising on our Service and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine non-personal information we collect with additional non-personal information collected from other sources. We also may share aggregated, non-personal information, or personal information in hashed, non-human readable form, with third parties, including advisors, advertisers and investors, for the purpose of conducting general business analysis, advertising, marketing, or other business purposes. For example, we may engage a data provider who may collect web log data from you (including IP address and information about your browser or operating system), or place or recognize a unique cookie on your browser to enable you to receive customized ads or content. The cookies may reflect de-identified demographic or other data linked to data you voluntarily have submitted to us (such as your email address), that we may share with a data provider solely in hashed, non-human readable form. We may also share your geolocation information in de-identified form with Foobee companies and third parties for the above purposes. To opt out of the sharing of your geolocation information, please discontinue use of the Foobee application.

Do Not Track Disclosure.

  Do Not Track (“DNT”) is a privacy preference that users can set in their web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. We are committed to providing you with meaningful choices about the information we collect and that is why we provide the opt-out links above. However, we do not recognize or respond to any DNT signals, as the Internet industry works toward defining exactly what DNT means, what it means to comply with DNT, and a common approach to responding to DNT.

Third-party websites.

  There are a number of places on our Service where you may click on a link to access other websites that do not operate under this Privacy Policy. For example, if you click on an advertisement on our Service, you may be taken to a website that we do not control. These third- party websites may independently solicit and collect information, including personal information, from you and, in some instances, provide us with information about your activities on those websites. We recommend that you consult the privacy statements of all third-party websites you visit by clicking on the “privacy” link typically located at the bottom of the webpage you are visiting.

How you can access and correct your information.

  If you have a Foobee account, you have the ability to review and update your personal information within the Service by opening your account and going to settings. Applicable privacy laws may allow you the right to access and/or request the correction of errors or omissions in your personal information that is in our custody or under our control. Our Privacy Officer will assist you with the access request.

  We will respond to requests within the time allowed by all applicable privacy laws and will make every effort to respond as accurately and completely as possible. Any corrections made to personal information will be promptly sent to any organization to which it was disclosed.

  In certain exceptional circumstances, we may not be able to provide access to certain personal information we hold. For security purposes, not all personal information is accessible and amendable by the Privacy Officer. If access or corrections cannot be provided, we will notify the individual making the request within 30 days, in writing, of the reasons for the refusal.

Data retention.

  We keep your information only as long as we need it for legitimate business purposes and as permitted by applicable legal requirements. If you close your account, we may retain certain data for analytical purposes and recordkeeping integrity, as well as to prevent fraud, enforce our Terms of Use, take actions we deem necessary to protect the integrity of our Service or our users, or take other actions otherwise permitted by law. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

Your choices about collection and use of your information.

  You can choose not to provide us with certain information, but that may result in you being unable to use certain features of our Service because such information may be required in order for you to register as user; purchase products or services; participate in a contest, promotion, survey, or sweepstakes; ask a question; or initiate other transactions.

  Our Service may also deliver notifications to your phone or mobile device. You can disable these notifications by going into “App Settings” on the app or by changing the settings on your mobile device.

  You can also control information collected by cookies. You can delete or decline cookies by changing your browser settings. Click “help” in the toolbar of most browsers for instructions.

How we protect your personal information.

  We take security measures to help safeguard your personal information from unauthorized access and disclosure. However, no system can be completely secure. Therefore, although we take steps to secure your information, we do not promise, and you should not expect, that your personal information, chats, or other communications will always remain secure. Users should also take care with how they handle and disclose their personal information and should avoid sending personal information through insecure email. Please refer to the Federal Trade Commission's website for information about how to protect yourself against identity theft.

  You agree that we may communicate with you electronically regarding security, privacy, and administrative issues, such as security breaches. We may post a notice on our Service if a security breach occurs. We may also send an email to you at the email address you have provided to us. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please notify us at help@foobeeapp.com.

Information you provide about yourself while using our service.

  We provide areas on our Service where you can post information about yourself and others and communicate with others. Such postings are governed by our Terms of Use. Also, whenever you voluntarily disclose personal information on publicly-viewable pages, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. We cannot control who reads your posting or what other users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your personal information. Except as required by a court order or other similar legal proceeding, we will only make messages you send to another user through our Service accessible on the Service, unless you expressly request a copy of your messages in accordance with applicable law. Should you wish to receive a copy of any messages you received from other users through our Service, you must first obtain their prior written consent and then they must contact our Privacy Officer to provide their prior written consent.

SECTION 4: WHAT OTHERS MAY SEE ABOUT YOU.

  If you register or login to the App using your Facebook account, you are authorizing us to access certain Facebook account information, including information you make available via Facebook, current location and those friends you have in common with other users. You also understand that your Foobee profile and other information you make available via the App, including information you provide directly or indirectly through Facebook (i.e., your Facebook photos, your name, age, approximate location, friends you have in common with other users and their profile information), may be viewed and shared by users with individuals who may or may not be users or via third party applications. For example, a user may recommend you as a match to his or her Facebook friends by sharing your picture, regardless of whether such friend(s) is also a user of the App. You might share information like the photos and messages you send or upload and any metadata provided with those messages, along with any comments or information you provide in connection with your photos.

  When using Foobee, you should assume that anything you post or submit on the App may be publicly-viewable and accessible, both by users of the App and non-users of the App.

SECTION 5: MODIFYING YOUR REGISTRATION INFORMATION.

  You may access or modify the Registration Information you provided at any time or permanently delete your Account.

  When your Account is deactivated, we take reasonable efforts to make sure it is no longer viewable on the App. We are not responsible for any information, pictures, comments, or other content that is deleted from our systems resulting from the deactivation of your Account.

  To prevent abuse and/or misuse of Foobee by a user following termination or deletion of a profile/Account we shall retain such information as we deem in our sole discretion may be necessary to ensure that user does not open a new Account and profile in breach of our Terms of Use and to ensure compliance with all laws and regulations.

  Even after you remove information from your profile or delete your Account, copies of that information may still be viewable and/or accessed to the extent such information has been previously shared with others, or copied or stored by other users or to the extent such information has been shared with search engines. We cannot control this, nor do we accept any liability for this. If you have given third party applications or websites access to your personal information they may retain such information to the extent permitted under their terms of service or privacy policies.

SECTION 6: THIRD PARTY ACCOUNTS, DISCLOSURE OF INFORMATION, AND PERMISSIONS

  If you have registered with Foobee using a third party social media platform, such as Facebook, you will be asked to sign in using your Facebook login. If you do so, you permit and authorize us to access certain Facebook account information, which may include your public Facebook profile (consistent with your privacy settings in Facebook), your email address, interests, likes, gender, birthday, relationship interests, current city, photos, personal description, friend list, and information about and photos of your Facebook friends who might be common Facebook friends with other Foobee users. You will also be asked to allow Foobee to collect your location information from your device when you download or use the Service. In addition, we may collect and store any personal information you provide while using our Service or in some other manner. This may include identifying information, such as your name, address, email address and telephone number, and, if you transact business with us, financial information. You may also provide us photos, a personal description and information about your gender and preferences for recommendations, such as search distance, age range and gender. If you chat with other Foobee users, you provide us the content of your chats, and if you contact us with a customer service or other inquiry, you provide us with the content of that communication.

  If you have registered with Foobee using a third party social media platform, such as Facebook, your Foobee profile will be available to all users of Foobee whether via our App or our partners' websites.

  Remember that when you register with a third party, you are also giving them personal information, so we recommend that you read their privacy policies as Foobee does not control how they use their information.

  If you have registered on one of these third party websites, such as Facebook, or you have verified your Account via a third party website, we may connect your Foobee profile with your profile on such website. We may do this by way of new products and applications which we introduce from time to time, including new products powered by our group companies.

  If you have created a Foobee profile through a third party website and you do not want to link your Foobee profile to your profile on the third party website, Foobee cannot amend these settings. Please visit the application settings on your third party website profile and follow the instructions to remove the Foobee access permissions.

  We only use the APIs, OAuth Tokens, Widgets, or other means provided by the applicable Social Media Account to integrate your Social Media Account with our App. As such, we only receive the limited information that each Social Media Account permits to be transferred.

SECTION 7: MUST BE 18 YEARS OF AGE OR OLDER.

  Although our Service is a general audience Service, we restrict the use of our service to individuals age 18 and above. We do not knowingly collect, maintain, or use personal information from children under the age of 18.

SECTION 8: SECURITY.

  We take commercially reasonable security measures to help protect your information against loss, misuse and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

  Unfortunately no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur. You should always log-out after the Service and periodically change your password(s). If you ever think someone has had access to your social media password, please report it to the relevant social media platform and change your password immediately. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

  FOOBEE EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR REGISTRATION INFORMATION OR OTHER DATA.

SECTION 9: ONWARD TRANSFER AND CONSENT TO INTERNATIONAL PROCESSING

  We are a growing corporation with users and operations in multiple countries, including the European Union and worldwide. We have developed data practices designed to assure information is appropriately protected but we cannot always know where personal information may be accessed or processed. While our primary data centers are in the United States, we may transfer personal information or other information to our offices outside of the United States. In addition, we may employ other companies and individuals to perform functions on our behalf. If we disclose personal information to a third party or to our employees outside of the United States, we will seek assurances that any information we may provide to them is safeguarded adequately and in accordance with this Privacy Policy and the requirements of applicable privacy laws.

  If you are visiting from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your personal data, including sensitive data, by Foobee from your region to countries which do not have data protection laws that provide the same level of protection that exists in countries in the European Economic Area, including the United States. By providing your personal information, you consent to any transfer and processing in accordance with this Policy.

SECTION 10: CALIFORNIA PRIVACY RIGHTS

  California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. If you wish to find out about any rights you may have under California Civil Code section 1798.83, you can write to us at help@foobeeapp.com

  From time to time we may disclose your contact information to third parties to allow them to market their products or services to you or for other marketing purposes. This may be information we received from you offline and online. If you want us to stop further sharing your email contact information with third parties (if we have your email contact information), you may notify us at help@foobeeapp.com.

  Please follow the instructions provided to you by third parties to unsubscribe from their messages. If you have opted-out as described above, and thereafter you chose to use a service or promotion that requires us to contact you or share your information with a third party, then your previous opt-out preferences will not apply to such service.

  In addition, under California law, operators of online services are required to disclose how they respond to "do not track" signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information of a consumer over time and across third party online services, to the extent the operator engages in that collection. At this time, we do not track our Users' personal information over time and across third-party online services. This law also requires operators of online services to disclose whether third parties may collect personal information about their users' online activities over time and across different online services when the users use the operator's service. We do not knowingly permit third parties to collect personal information about an individual User's online activities over time and across different online services when using the App.

SECTION 11: UK AND EU RIGHTS.

  You must be at least 18 years of age to create an account on Foobee and use the Services. By creating an account and using the Services, you represent and warrant that:

  1. Right to be informed: what personal data an organization is processing and why (this notice).
  2. Right of access: you can request a copy of your data.
  3. Right of rectification: if the data held is inaccurate, you have the right to have it corrected.
